Possession, trafficking and the alleged role
Stellar Law represents clients charged with drug possession, trafficking and possession for the purpose of trafficking. The substance, the alleged conduct and the evidence connecting the client to it must each be examined. Being charged alongside other people does not remove the need to assess the case against each individual.
Rana and her team review the allegations with the client and identify the decisions that need to be made early. These may include urgent bail representation, compliance with release conditions and the preservation of records relevant to the defence.
Searches, seizures and disclosure
The defence may turn on a vehicle stop, a search of a home, a warrant or an encounter with police. We examine the legal basis for the search, the sequence of detention and arrest, and the records showing how evidence was collected and handled. Any potential Charter challenge must be supported by the facts and the applicable law.
Disclosure can include surveillance, police notes, laboratory reports, photographs and electronic communications. We identify gaps and consider whether the evidence supports the role attributed to the client. The significance of a message, a location or an item of property cannot be assessed reliably in isolation.
Testing the allegation of trafficking
The Controlled Drugs and Substances Act separately prohibits trafficking and possession for the purpose of trafficking. A defence requires attention to what conduct is alleged, what the client knew and what the Crown Attorney relies on to establish the purpose of any possession.
We examine the proposed inferences from quantities, packaging, money and communications. Where several people are involved, we separate the evidence concerning the client from the broader narrative of the investigation. We then advise on the available challenges, appropriate negotiations and the work required for trial.
Arrange an Initial Conversation.
Have the charge documents, release paperwork and next court date available. Do not send sensitive evidence through the public enquiry form. We will explain how to provide material securely if the firm is retained. For someone being held for a bail hearing, call directly.
Questions About Representation
Can a search be challenged?
Potentially. The grounds depend on the police powers used, the client's privacy interests and the circumstances of the investigation. An unlawful search does not automatically decide the case; the legal remedy also needs to be assessed.
Can a family member contact Stellar Law after an arrest?
Yes. A family member can call to discuss arranging representation and provide practical information for a possible release plan. For urgent bail matters, use the telephone rather than waiting for an email reply.
