The first bail hearing matters
The first bail hearing can shape the course of a criminal case. A detention order can leave an accused person in custody for months, with consequences for employment, family life and the ability to prepare a defence. Although the hearing does not determine guilt or innocence, the decision about release has immediate consequences.
That is why preparation matters from the outset. Rana and her team assess the allegations, identify the obstacles to release and develop a plan that responds to the concerns before the court. If bail is denied, detention can extend to trial unless a lawful basis for release arises.
Preparation for the bail hearing
Stellar Law examines the available bail disclosure, the accused person's record and existing court orders. We establish why the Crown Attorney opposes release, identify the legal burden that applies and prepare a response to the grounds for detention. The work must address the issues that will decide the hearing: attendance in court, public safety and confidence in the administration of justice, as applicable.
A proposed release plan needs more than assurances. We work with the client and those supporting them to confirm where they would live, what supervision or other support is available, and whether the proposed conditions can be followed in daily life. Employment, treatment and family responsibilities must be considered alongside any restrictions the court is asked to impose.
We discuss the plan with the Crown Attorney and pursue an agreed release where appropriate. If the hearing is contested, we prepare the supporting materials and arguments for release, addressing weaknesses in the plan before they are tested in court. The aim is a persuasive, properly supported proposal that the court can assess.
Preparing family members and proposed sureties
Family members often provide information essential to a release plan. Our team helps identify what needs to be confirmed, including living arrangements, available support and existing restrictions. Early contact gives us the opportunity to resolve gaps before the hearing.
A surety is not required in every case. Where one is proposed, we explain the allegations, the proposed conditions and the responsibilities they would undertake. We assist with the required declaration and prepare the person for any attendance or questions the court requires. A proposed surety must understand the commitment and be able to carry it out.
Representation beyond the hearing
Rana and her team represent individuals from bail hearings through to trial. Preparation at the bail stage forms part of that continuing work: understanding the allegations, advising on the choices ahead and developing the defence. We discuss the scope of representation, fees and retainer arrangements before you commit.
If someone close to you is being held for a bail hearing, contact Stellar Law as early as possible so we can assess the situation and begin preparation if retained. For urgent bail matters, call 416.821.2529. For a non-urgent enquiry, book a telephone consultation or request a callback below.
